Is seeing believing? That's just one question sits at the heart of a new lawsuit against Los Angeles County – one that echoes a dispute the county has faced before.

Similar to the case of a Christian lifeguard who sued L.A. County over a Pride flag flying at his beach station, this new lawsuit involves an employee who claims that having to pass a Pride flag outside his office violates his sincerely held religious beliefs. The employee is not being asked to raise the flag, display it, or endorse it. He simply has to walk past it on his way into work.

Is Visibility an Infringement on Personal Beliefs?

The employee in question is Eric Batman, who has worked for the L.A. Department of Public Works since 2003. L.A. County began requiring the Progress Pride flag to fly outside county buildings each June starting in 2023. Batman claims that even seeing the flag forces him to "celebrate, recognize, and solemnize conduct and actions that he views as sin," in conflict with his Christian faith. The lawsuit was filed in March by the anti-LGBTQ+ evangelical legal organization Liberty Counsel.

In both 2024 and 2025, Batman formally requested a religious accommodation allowing him to work remotely for the entire month of June, arguing that being required to work in an office flying the Pride flag violated his rights. Both requests were denied, as were follow-up grievances he filed with the Department of Employee Relations.

The Suggested Solutions

Rather than grant the remote work request, Batman's employer offered two alternatives: use the building's rear entrance to avoid seeing the flag, and seek counseling for any distress the flag might cause.

Batman's legal team argues those suggestions made matters worse. According to the complaint, they implied his religious beliefs required mental health treatment rather than accommodation, and relegated him to a kind of "separate but equal" arrangement. The suggestion to use the rear entrance, they contend, is no different from directing someone to a back door on account of who they are.

Batman Sues

Liberty Counsel frames Batman's request as essentially equivalent to accommodations already granted to Muslim employees at the department who work remotely during Ramadan. If the county can make room for one religious observance, the argument goes, it should make room for another.

The lawsuit alleges violations of Title VII of the Civil Rights Act, the Free Exercise and Free Speech clauses of the First Amendment, and the Equal Protection Clause of the Fourteenth Amendment. Liberty Counsel chairman Mat Staver stated that the Constitution does not allow a government employer to put citizens in the position of choosing between their conscience and their livelihood.

Worth noting: the lawsuit itself contains no instance in which Batman was required to do anything other than come to work while a flag flew outside. He was not asked to attend a Pride event, wear a symbol, or make any public statement. Liberty Counsel's own fundraising materials went further than the complaint, claiming the county had declared his beliefs a "mental illness" – a characterization the lawsuit does not actually make.

Where Does This Leave Us?

Cases like this one put two sincere commitments in tension: the right of employees to practice their faith without penalty, and the right of public institutions to acknowledge the communities they serve. Neither is trivial. Religious accommodation law under Title VII requires employers to make reasonable adjustments for sincere beliefs – but courts have generally held that passive exposure to a symbol does not constitute compelled participation in what it represents.

This lawsuit sits at a fault line that American law and culture are still working through. The debate over how far religious freedom extends in public institutions has been a recurring one, and cases like Batman's are unlikely to be the last.

    I want to open the topic of "what is a sin?" here. Religion can be something very helpful for people, but it can also be difficult throuh conservative beliefs and the fact what people made out of it over centuries. Wouldn't it be the best for all to reframe things and get rid of the lable "sin" for the actions which are meant here? LGBTQ+ People just want to be themselves and not being seen as sinner for that and taking away this lable would also make it easier to accept their existence for straight/cis people which are in doubt about loving everyone.

    Firstly, I feel a great deal of sympathy for Mr. Batman. I cannot imagine the extent of teasing he went through during his school years because of that last name.

    This isn’t about some silly lawsuit and the supposed rights of one Christian man being offended by a Pride Flag.

    Every June, we seem to have the same argument. Some people don't want to see us. No Pride flags. No Pride parades. No public celebrations. No acknowledgment that we are part of every family, every community, and every faith tradition.

    What is LGBTQ Pride?

    Pride did not begin because of the AIDS crisis. It began because LGBTQ people wanted the same freedom, dignity, and recognition as everyone else. But during the 1980s and 1990s, Pride became something more. As thousands of people died from AIDS, many were treated as though their lives didn't matter. Families were torn apart, partners were ignored, and an entire community was often met with silence, judgment, or indifference.

    When society pretended we didn't exist, our suffering became easier to ignore—and thousands paid the price. Pride became a way of saying, "We are here. We matter. We will not be ignored." We were not going back into the shadows, and we aren't going back now. That is why a rallying cry that emerged during that era still resonates today: "We're here, we're queer, get used to it."

    When I was young and going to school I saw many cars pass by our bus stop with statue of Mary inside cars on their dash board going by. Today, I see statues of the angel Moroni on top of the Steeple on Mormon Church (Church of Jesus Christ of Latter Day Saints). I don't agree with the angel Moroni but that is the Mormon belief. There is a lot of things I don't agree with but as a Minister, my job is to lead people to Jesus Christ. If I make a scene about what I agree or disagree with, people wouldn't listen to me.

    I'm tired of all the LGBTQIA2 whatever+ bullcrap! But, that being said, I don't think Batman has a case. He could use the rear entrance. It seems to me that he just wanted a month off work. I believe in freedom of speech and freedom of religion, which is what our American forefathers established. I don't mind seeing a rainbow flag, but I am completely against them promoting gay and trans ideology on our children in elementary schools and teaching them to change their genders. Even our fellow church leaders in the Satanism communities wouldn't come up with something so evil and perverse. Batman doesn't have a case, but he's leaning in the right direction.

    Exodus 20:4 clearly states that we are not to create "any likeness of any thing that is in heaven above, or that is in the earth beneath", and implies worship of such images. In spite of this clear instruction, I see Catholics praying to statues and images of Christ and Mary often. Should I be offended by this? Should I be able to sue any church that displays any of these items where they can be seen from public grounds? What about Nativity scenes? They are graven images of things now in Heaven.

          I disagree.

          In the Dallas area, we've seen demonstrations that shut down traffic for hours, acts of vandalism against public and private property, and assaults committed by individuals claiming to be acting in defense of various causes. These are not inventions or exaggerations; many of these incidents are matters of public record.

          What I find interesting is that when members of a group engage in violence against members of that same group—as was recently reported in an aggravated assault involving patrons at the Tin Room—it undermines the narrative that all criticism comes from outsiders or opponents. Sometimes the problems originate within the community itself.

          You and I clearly view these issues differently. That's fine. Reasonable people can look at the same facts and reach different conclusions. What is less productive is dismissing opposing viewpoints without addressing the substance of the argument.

          My own view is simple: people should be free to live their lives as they choose, provided they extend the same respect to others, obey the law, and refrain from violence, intimidation, and property destruction.

          On a separate note, what is your fixation with name-calling? Is a respectful discussion beyond your capability?

    One can rationalize a country flag, or state flag, but the flag situation has become a symbol not of pride, (as is Ol' Glory), but a forced, in your face support for an action or party.

    A good example of this was what happened in our town where a pride flag was set up, to the objections of people not into the pride movement. Then a BLM flag appeared, then a Trump flag, then a small groups independence flag, a militant group flag, and finally something which to this day I have no idea what it stood for.

    The elephant in the room is not who you support, but the fact that your pride often encroaches on those who don't share the same feeling. It's like the Presbyterians setting up flags for their faith outside a Baptist church. In their mind they are "taking pride" in their faith, while the Baptists see it as an encroachment on their faith. It becomes the age old challenge of "I don't care what your party and celebration is about, but keep it in YOUR yard and not violate my space."

    A simpler example; you have a family who loves heavy metal rock and a family next door who likes country music. Who has the right to play their music loud enough that the neighbor gets tired of the noise. And when it becomes competition by turning up the amplifiers to drown out the other, who has more moral conviction?

    I get it that one might be proud of their organization, but where is the line between your pride and happiness and another's contempt and misery.

    And why is in the wrong when they foist their flag on others, especially when they know it may offend.

    As you can read in this thread, there has been many unkind replies from people wanting their will, their flag to be foisted on others. And I find it uncanny that in some cases a connection is made to Jesus, when I believe Jesus would become angry over the "competition" and probably solve the problem by saying neither can fly their flag.

    As for me, I have one flag. The stars and stripes. And when I play my music (60s/70s rock), I do so at low volume where its not mandatory that someone must listen to my choice of music. Yes, be proud of yourself, but don't force your will, flags, symbols, and speech on others in an aggressive fashion. Once you do so, you lost your moral superiority and become an attacker.

    The GLARING difference between being offered an alternative entrance into a public building and being LEGALLY FORCED to use the back door (as has been the case in America’s not so distant past) is CHOICE. This exposed me to public prayers pledges of allegiance and other disgusting to me religious event's I would rather not see and or hear several times a week .

        Your reply is untrue. Rene Good was firmly within her rights and following a legal order by an officer to drive away. The officer that tried to place himself in front of her car was never in any danger. It was murder, pure and simple.

            This is only in the RED states. BLUE states are suing the USDA and refuse to submit their data like the red states have, so the USDA is going to suspend any payments to those states until they have provided the data as to who is receiving benefits.             I have experience of living under Democrat rule here in California. They have absolutely no idea what they’re doing, and have slowly run it into the ground what used to be a beautiful state. In many areas, it’s a hell hole, crime is rampant here in LA, much like it is in Chicago, and we have the highest gas prices in the Nation. My vehicle registration is $474. In Texas it would be $72, Places have burned to the ground and they didn’t know how to deal with it. Their ability to manage is non-existent. I hear San-Francisco is just as bad, if not worse. But hey-ho, not to worry, we are looking after illegal aliens really well with our tax dollars, while homeless vets, and those that are drug addicted camp out on Skid Row in their thousands.

            If you are excited about its end, come to Los Angele’s, or San Francisco and experience what “end” really looks like under Democrat rule.

            I’d rather be an American 🇺🇸 than a Democrat.

                No one knows what Jesus ever said, assuming he was real of course, because everything you are reading in any bible about what you “think” Jesus said was written by historians that never met him because they they were born after the death of Jesus.

                Interestingly, the historians that we know of that did live during the time of Jesus never wrote about him. Don’t you find that to be weird?

            Interesting you say that George Washington said, "I give this new empire 250 years before the people rebel again from the new king you insist on making me." It only took 15 years before the ten Admendment writter James Madison went before Congress said, "There is other a shadow of right for the government to dictate where religious morals exist. The government has no place to dictate whom or what a man marries." Then I 1861 rebellion over taxes again not slavery that wasn't an issue until last year of the war. This year is 250th year birthday and the powder keg is waiting for the match.

              Now, that said, I tend to agree with the message... The US is a baby country compared to the rest of the world. We're celebrating 250 years, when most of Europe, Asia, & Africa have existed for thousands. We've had one Revolutionary war to gain our independence. & We've had one Civil War. Most other countries have had dozens if not hundreds.

              As far as the whole rainbow thing, what ever man... Just keep drag queens out of the classrooms, and kids out of pride parades.

                I know this is hard to except but there is are these wonderful things called books. They are made of paper and have history, science, and math and many other things written in them. Not all are put on the internet and google don't have all the things Yahoo does are other search engines. But my information coming out a 1984 American History text book from my High School. Since they've been rewriting history to suit there agenda not surprising no one knows true history.
