
Ten years ago, the Supreme Court legalized same-sex marriage nationwide. Now, for the first time since then, they’re formally being asked to overturn that ruling.
The case is being brought by former Kentucky county clerk Kim Davis, who made headlines in 2015 for denying a marriage license to a gay couple following the nationwide legalization of gay marriage due to Obergefell v. Hodges.
Now, nearly a decade of legal troubles and a mountain of debt, she’s seeking legal restitution – and LGBTQ+ activists fear that she may have the sympathies of a heavily conservative Supreme Court.
Is same-sex marriage in trouble?
The Return of Kim Davis
As the Rowan County clerk, a significant part of Kim Davis’ job was to issue marriage licenses to couples. But in 2015, following the nationwide legalization of gay marriage, Davis stopped issuing marriage licenses to gay couples “under God’s authority,” arguing that doing so violated her sincerely-held religious beliefs in the sanctity of marriage.
Amid a lawsuit from one of the aggrieved couples, Davis refused to budge or resign her post, and she was jailed for contempt of court. A jury verdict ordered her to pay $100,000 to the couple for emotional damages and she owes the couple $260,000 in attorneys’ fees.
Davis is now formally petitioning the Supreme Court to overturn Obergefell, with her attorney Matthew Staver arguing it was “egregiously wrong,” “deeply damaging,” and “far outside the bounds of any reasonable interpretation of the various constitutional provisions to which it vaguely pointed.”
“The U.S. Supreme Court should overturn the wrongly decided Obergefell v. Hodges opinion,” says Staver, “because it threatens the religious liberty of Americans who believe that marriage is a sacred union between one man and one woman.”
Will Gay Marriage Be Overturned?
Will Obergefell be overturned? That was the fear that many had back when the Supreme Court decided to roll back Roe v. Wade in 2022.
In his concurrent opinion with the Roe reversal, Justice Clarence Thomas even showed his eagerness to revisit other Court rulings based on substantive due process, including the rulings which legalized contraception access, same-sex marriage, and even gay sexual intimacy.
The Obergefell ruling is one which Davis’ own attorney calls “legal fiction,” and at least a few on the nation’s highest court agree. With a 6-3 conservative majority, and with Justice Thomas and Alito both openly showing interest in revisiting Obergefell, many anti-gay activists believe now is the time to strike.
And Davis’ case is of major interest to them because she’s believed to be one of the few individuals in the United States with the legal ground to bring a relevant case to the nation’s highest court.
What Happens if Obergefell Falls?
So what happens if Davis has her day in court, and they side with her?
32 states have enforceable laws on the books banning gay marriage. That means that in an instant, same-sex marriage would be illegal in more than half of U.S. states. In anticipation of a future legal challenge to Obergefell, then-President Biden signed the Respect for Marriage Act into law, which ensures federal recognition of same-sex marriages.
The Supreme Court will decide this fall whether to take Davis’ case, and should they accept, it will likely be heard next spring. But Supreme Court watchdogs say that some of the Court’s justices – Kavanaugh, Coney Barrett, and Gorsuch – seem disinterested in taking the case.
Still, LGBTQ+ activists say that Kim Davis’ case represents the largest risk yet to marriage equality – and they fear that in just a year, same-sex marriage could be wiped out in more than half of the states.

I start to agree with Jerry listed above, marriage is a word that has different meanings as does the word "gay" in my lifetime. Remember the old Christmas favorite, as happy and "gay". If the purpose of gay marriage is for legal activity, whatever the reason, then it is either legal or not, but should be called a "civil union". If they want to call it marriage that is like taking the word "gay". If in reading the Bible, you believe that marriage is man-woman, then you are correct in your use of the Bible and the word as listed. If you read the Bible differently, then you have a civil union, with all rights of a marriage in the face of the law. Not too hard to see, it is more the renaming of a word and maybe not the civil meaning. Just my opinion, as too many words are changed for the benefit of some and those who don't agree are usually hated.

Marriage is a biblical institution in the bible made before sin even existed. We as a people have no right to change God's laws. If the state wants to make a law to give gay couples a tax break then they should make a law for it but not call it marriage. Scripture states that marriage is solely between a man and a women, so that should not include gay couples. The bible calls it sinful. I pray for sinners to be saved but they must come to Christ and listen to the Holy Spirit for direction and be obedient to scripture. No scripture states that gay couples should be married so it should not be a law. You have freewill but you will have to answer for it on the day of judgememt. We all will. But let whoever is without sin cast the first stone. God is big on obedience. Disobedience caused Israel much hardship, even to be put in slavery. I would think long and hard about willful sin. I fail to understand how a law that allows people to do something that doesn't affect other people could be infring8ng on those other people's religious rights to not choose to do the same thing themselves. This is literally like pork being legal for everyone to eat if they want, but Jews that keep kosher are religiously restricted from doing that...and we've never seen Jews going to the Supreme Court to demand that pork be banned.
Having legal same-sex marriage be banned would absolutely infringe on my religious belief that same-sex marriage is exactly like different-sex marriage and needs to be legally. That law would pose a definite obstacle to my practice of my religion. It poses no obstacle to Kim--all she had to do was get someone else to process the marriage licenses she didn't want to touch, exactly the way the deli I worked in allowed certain employees to forego handling pork, or even raw meat in general (the vegetarian). And if they were against meat at all--why in the hell would they want to work in a deli?
Kim is a particularly vicious piece of work. She wanted the right to stop other people from living their lives according to their own religious beliefs, so she deliberately put herself in a position where that would clash with her own beliefs. And now she wants others to be punished for her unwillingness to do the job no one forced her to apply for or stay at. I hope she gets pooped on by pigeons every time she steps outside.

When I read all of these different comments, I notice one idea or understanding that is missing. What is sexual attraction? Am I supposed to be proud that I am such a good person that I have never felt attracted to another man? I have been around women where I had to control my feelings because I am faithful to the woman I love and I wanted to remain faithful to her.
I am not gay and I do not find men to be attractive. Being gay is not a question of good or bad. It is about a natural sexual attraction. Some people are born gay and some are not. Not desiring men does not make me a good person. It is the way I was born. Many people are turned off to same sex attraction and so they have strong reactions to people who do things they would never do.
Science has pretty well established that gayness is a natural occurrence in many people. Common sense should help us to understand this too. Unfortunately, most anti-gay readers will discount this and not consider their feelings. They think they are good because they have never had these feelings and those who do are bad. Honestly think about it.

Ms. Davis had problems not because she chose to follow her religious beliefs, but because she chose not to do her job. Jesus specifically told His followers and others that they need to separate their religious beliefs from secular law, and marriage licenses are secular, issued by the State, not issued by the Church or God. Ms. Davis's beliefs should not have prevented her from carrying out her secular job. If we followed God's laws to the letter in all cases, then churches would be closed on the Sabbath, and Christian doctors and emergency responders would not be saving lives on that day, because they would be resting.

Dear friends, while I respect the sincerity of Kim Davis’s faith, I grieve her attempt to revoke the legal recognition of same-sex marriages. From a Universalist perspective, the heart of the Gospel is that “God is love” (1 John 4:8), and that love is not restricted to certain people, unions, or expressions of covenantal faithfulness.
Jesus consistently broke down barriers—eating with outcasts, touching the unclean, and lifting up those whom society rejected. When the law was used to exclude, He reminded us that “the Sabbath was made for humans, not humans for the Sabbath” (Mark 2:27). In the same way, marriage should be seen not as a tool of exclusion but as a sacred space where God’s love can be revealed through mutual care, fidelity, and grace.
To deny couples the right to marry is to withhold a blessing of stability, dignity, and recognition that reflects the very covenantal love of God. A truly Christian response is not to close the doors of grace but to open them wider, remembering Christ’s words: “By this everyone will know that you are my disciples, if you love one another” (John 13:35).
In the end, God’s love will reconcile all things (Colossians 1:20). As Universalists, we hold hope that no one is excluded from that reconciliation—and our calling now is to live as witnesses of that all-embracing love.

I personally feel gay anything is sin. That being said I have friends that are gay. They know my feeling towards gay being sinful, but they also know I treat them politely, I truly care about them when they are struggling with something's.

This latest by Kim Davis actually has nothing to do with her religious beliefs. Nope - she's still fighting against paying the damages she was ordered when she lost her case. So the only way she can get out of it is to have the Supreme Court overturn their Obergefell decision. This Court has no respect for Stare Decisis. They overturned Roe. Now Obergefell is in their sights. However, as long as Clarence Thomas is still on the court, Loving will not be touched - despite White Nationalists calling for IT to be overturned, too.

Doesn't our religious liberty matter?
How is that even possible. If your faith is so fragile, having a law that legalizes something you don't believe in "threatens" your religious liberty, you really need to take a closer look at those beliefs. Using this same logic, having a church of a different faith or even different Christian denomination should be illegal because someone's faith might be "tested" by it. The Southern Baptists do not believe in drinking (neither do the Mormons, Church of Christ, and many other Christian denominations, and faiths, including Islam, but I don't see any of them lobbying to bring back Prohibition.

This woman refused to do the job she had sworn to do. She claimed God would not allow her to issue marriage licenses to same-sex couples, that it went against her sincerely held religious beliefs. Her job description did not mention an “except for” clause.
Why is same-sex marriage so threatening to everyone? I have a husband that I truly love. We have been together for over 27 years now, and to my knowledge, it has not harmed anyone. My nieces and nephews did not turn gay from exposure to the two of us. They see two people who love each other. They see a stable, long-term relationship between two men. They don’t think it’s strange because they’ve never been taught it was wrong.
According to Justice Thomas, same-sex marriage is not enough. He is ready to overturn Lawrence v. Texas, which would make sodomy laws legal again. People like me could then be arrested and charged with crimes for what I do in my bedroom. Conservatives say, “Keep it in the bedroom,” but then they’re the creepers looking through my window.
And if equality can be taken away from one group, it will be taken away from others. Wait for it.

I'm very sorry james, it's not possible for a man to have a husband. Nor can a woman have a wife. Sure enough they can spend time together in a loving and loyal relationship for their entire lives but same sex unions simply aren't interchangeable with married couples. It's impossible.
Let there be insurance covered same sex unions where all taxation, inheritance and any other government intrusions are equally applied and let the definition and meaning of marriage remain logically definable and defendable.

I know that's the new definition but that's not really what it means. People have changed it to fit whatever they want it to be. It's like taking to the design print to a part that's out of specification and changing the tolerance to match the part so the part is now within specification.

What law book are you pulling this from, SOJ? I hope you’re not talking about the Bible because it’s not the law. It is, at best, a guidebook written by men. And those who think God wrote it—or for that matter, inspired it—are just kidding themselves.
It’s the height of human arrogance to assume that every personal bias or cultural tradition we hold must be the very voice of God. Too often, what people call ‘God’s will’ is nothing more than their own ego speaking, dressed up in divine authority.
At the end of the day, marriage—by law—is a civil contract. And in a nation that claims liberty and justice for all, every citizen deserves equal access to that contract without someone else’s religion acting as the gatekeeper.

The Bible, if you look at it from a historical perspective shows that God's commands and notions evolved with time as God's creation evolved up until and past the time of Jesus. Who's to say that as society has changed and our human race has evolved in the past 2,000 years that God's notions of the rules hasn't also changed. This should be especially poingent for those who subscribe to the "God is in control" mentality.

Anthony, He did not write the Bible; therefore, the words written within it are not His. They are man’s words, not God’s word. A man 2000 years ago saw something he found distasteful and said, “God told him this was a sin.”
It’s no different than a man today claiming, “God told me I’m the modern-day Moses,” or another saying, “I am the chosen one.”

At the same time, I remember how many parts of the Law we no longer hold as binding—what we eat (Leviticus 11), what we wear (Leviticus 19:19), or even how we honor the Sabbath (Exodus 20:8). Christ Himself said He came to fulfill the Law (Matthew 5:17). As Paul reminds us, “Love does no harm to a neighbor. Therefore love is the fulfillment of the law” (Romans 13:10).
My prayer is that we let love be the measure of our words and actions, so that the Gospel may bring healing and hope. Pax et bonum.

I couldn't agree more. Love everyone. But it does not say anywhere in His word that we are to accept sin (any sin for that matter) as a non-sin. Are we not to love murderers, fornicators, pedophiles, etc. as well? We do not accept those as non-sins, the way you are trying to twist God's word to say it is ok to be a practicing Gay individual.

No disrespect intended, but that is a Distortion of the intent of the word of God. You can love your brother, but do you sleep with him? Do you have sexual relations with him? These acts are abominations' in the eyes of God. God created one man and one woman, Commanding them to "Go forth, be Fruitful and Multiply." Anything else violates the law of God.

So what? That just the opinion of the ancient old men who created that particular book of disconnected ramblings. And make no mistake, all religions are just nothing more than a collection of OPINIONS.
The problem with those opinions though, is that they have no substance behind them, none of any kind whatsoever. Romans says this, Corinthians says that and Uncle Tom Cobbley says something different. So what?
If one is going to argue from a god believers point of view, then one must first PROVE that your god exists. And that proof will not come from argument.
It will only come from empirical, demonstrable, repeatable and actionable EVIDENCE. Now the god believers have had quite a few thousand years to come up with this evidence - and where is it?

And until you can provide this evidence, then you must remain silent and leave the room as you have nothing of any substance to contribute to the matter.

You may read the bible a thousand times but there are only two passages that will give you all of the guidance anyone needs. These are first; "Judge not. lest ye be judged" (Mathew 7:1) Who are you to sit in judgement of anyone? You are not the moral compass of anyone's life. These are the words to remember and contemplate before opening your mouth to bestow judgment or condemnation. and second; "A new commandment I give to you, that you love one another: just as I have loved you, you also are to love one another". (John 13:34) If you run down these two verses in your mind before you speak (or type) or just simply ask "Am I judging someone? or does this show love, compassion and/or empathy for the person, or persons, whom I am addressing?" If your answer is no to either then maybe you shouldn't speak at all. Let the person without sin cast the first stone. Tend to your own flock. Do no harm.

Please go to Romans chapter one read it. Paul lays out. Also God gave man free will so nan can follow GOD or chose his on pathway that leads away from God. God as declared a man laying with man as a woman is a sin. So it is a man's choice on which path it takes.

When I first came here I was opposed to gay marriage because I thought it was contradictory to logic. Then after reading heartfelt opinions from the LGB members here I changed my opinion. Then after getting threatened with physical harm from a certain Muslim here, reading posts calling for the death of Christians and those posts getting many thumbs up, watching a real and true hatred towards Christians be permitted by moderators, I've changed my mind again.
I'm fine with a civil union but only a man and women can get married. That one's set now. I'll not traverse with those that desire my demise ever again, not one step. Jesus was right when he said not to traverse with the enemy.
Let's hope they can pull it off and restore the dignity and definition of marriage.

But only if it comes with the same rights and protections as a marriage... This includes tax incentives, rights of inheritance and custody of children, and the rights to speak for each other in medical situations. Then consider, if this were the case, why have separate rules with the same outcome with the only difference being the sex assigned at birth of the participants? That only creates more paperwork and confusion, especially if one or both participants are gender fluid or transgender. I applaud you for having an open mind and even being able to change it, but do it for the right reasons. Flip-flopping because of whoever has the loudest voice is never a reason to change your mind. Please, listen again to the heartfelt logic of those LGB, and reconsider once again.

In the UK, we brought in Civil Partnerships (CP) for gay couples. They were the same as marriage in all but name. Later we brought in gay marriage which meant gay couples had a choice of CP or marriage. As that discriminated against straights, now straights can opt for CP if they wish. It would have been simpler to just have gay marriage in the first place but the government gave in to christian activists. The Church of England having its own, unelected, representatives in Parliament was a factor too.

If you think that 2 people of the same sex shouldn't be allowed to marry, then don't marry someone of the same sex. Seems simple enough. What's next? Reverse Loving v Virginia, or Griswold v. Connecticut?
