Is it constitutional to deny someone housing because they’re gay?

A lesbian couple from Missouri has filed a lawsuit against a senior living center after their housing application was denied when the owners discovered they were gay.

Mary Walsh and Bev Nance have been together for 40 years and have been married since 2009. After touring the facilities at Friendship Village senior living community, filling out an application, and even putting down a deposit, their new apartment seemed like a done-deal.

But before the agreement could be finalized, the residence director called to question Walsh and Nance on the nature of their relationship. Soon after, they were informed their application had been rejected.

The couple decided to file suit.

Living Biblically – AKA No Gays

Although representatives from Friendship Village have thus far declined to comment, it seems that religious belief was responsible for the rejection. The organization’s website explains that it is “guided by Biblical values” and its cohabitation policy defines marriage as “the union of one man and one woman, as marriage is understood in the Bible.”

Apparently, Mary Walsh had specifically asked during their initial tour if the community would have a problem with two married women moving in together. “The guy looked at me like I had three heads and said, ‘No, we don’t have any problem at all.’ He looked at me so strangely I never asked the question again,” Walsh explained.

Do They Have a Shot to Win?

The lawsuit filed in U.S. District Court this week claims the senior living center denied the couple’s application based solely on their sexual orientation. “Mary and Bev were denied housing for one reason and one reason only—because they were married to each other rather than to men. This is exactly the type of sex discrimination the Fair Housing Act prohibits,” said the couple’s attorney. “Their story demonstrates the kind of exclusion and discrimination still facing same-sex couples of all ages.”

However, legal experts think Marsh and Nance will be fighting an uphill battle. Although housing discrimination based on things like race and sex is definitively illegal under federal law, there’s no law preventing discrimination based on sexual orientation.

Walsh and Nance have seen the gay rights movement evolve from its infancy. they were alive during the Stonewall riots, when being openly gay was basically unheard of. And decades later, they witnessed a long-sought victory: the legalization of same-sex marriage. And yet, even after all these years, they’re still facing obstacles.

“All this stuff just keeps coming at you, and then you’re in your 70s, and you think it’s going to be easy from now on and then you face this kind of prejudice. In my mind, the time has come for this to be corrected,” Walsh said.

Even if Walsh and Nance end up losing their case, Friendship Village might want to consider a name change, for this type of treatment doesn’t come off as particularly friendly. At the very least, they should put an asterisk next to their name explaining that “gays need not apply.”

    If gays are so great, then there should be PLENTY of HIGH-QUALITY places willing to house them. Frinedship Village and its residents don’t want to be around that, so they shouldn’t have to. They should have the CHOICE of what KIND of community they build!

            If you are a Christian you should be quoting stuff from Matthew on word. Not Leviticus. The Old Testament serves as a historical reference only. It was a time of law, both the death burial and resurrection of Jesus we are now under the time of Grace. So claiming the Bible forbids cutting of a beard would be quoting the Bible incorrectly.

Also, the New Covenant does not say it will do away with the law. If a gay couple wants to love and praise God we don’t stop them any Christian that discriminates against someone else are not true Christian’s.         Stephanie, you make the mistake of over generalizing here. The retirement organization clearly states its ideas concerning marriage. And as a private company, they have the right to vet their applicants to ensure they meet the requirements of the company. Don’t fault a company because they adhere to the tenets of any religion. Celebrate their efforts to abide to the doctrines outlined in that religion. Far too few are able to follow tradition and that’s where the enemy awaits us all. When we deviate from the standards we lessen those standards.

Christianity has closed their minds and hearts so they believe only “they” hold the secrets of divinity. They wave their “book” around like a weapon. If I were born Homosexual; I would still love God and the Son Christ Jesus; despite I would be rejected, I would have been born that way, without choice; contrary to God’s wishes. My query is what if The Word was created for the signs of the time, long ago, where inmorality ran rampid; and The Word saw it appropiate for mankind not to swich sexual partners at will, inclduing animals and relatives. Time and chemical corruption in insemination could have created havoc in the miracle of birth, not intended by our our Lord, because Adam and Eve sin we are now here. I ask your forgiveness for doubting my Father’s Words. I am like you; in my hear lives the Holy Spirit, and I will comply with my Fathers commandments and guidelines, which you beautifully wrote down. I thank you. I wish you success.

      Jesus was against the religion of his day. In keeping with that they included the old testament in the Bible to show Christians how not to be. Therefore, anyone who abides by the old testament is against the way of Jesus and cannot truly be a Christian. Much of what Jesus said and didn’t say contradicts the old testament as well. St. Paul added some of his own beliefs of which Jesus never spoke of and should not have been included in a book of christian instruction, i.e. the Bible. I might have to start a new Christian sect that has its own book that only covers the teachings of Christ. Anyone care to join me? I’ve also got a brand new coffee pot, so we can stay up late while forming the first true Christian religion. And that sounds like a good thing to call it. The First True Christian Religion.

Personally, I’m not sure he even existed since his story is very similiar to many other cultures beliefs of their own deities. The old testament is a history story of some very outrageous claims that have been traced back since ancient Samaria. The new testament, what wasn’t taken out, was mostly written by supposedly Jesus’s disciples, who still have different accounts of his words, and used their own interpretations to build their own churches. But if you would like to start a new branch, my all means you should do it and maybe teach these people about….THE POINT…to love another. You don’t have to agree with everything, but we are all part of this society, Unfortunately, and we still need to live together and function in a way that benefits everyone.

You also need to study a history of the early church which had many various interpretations of who Jesus was and what he taught.     In the article, the women state that they asked during their initial tour if the place would accept a lesbian couple and were told there would be no problem. To have that retracted and have their application denied for “sincerely held religious beliefs” is utter codswallop. I would bet there are others living there, not to mention working there, who have been divorced, committed adultery, probably broken laws, have tattoos, don’t honor their parents, or any number of other no-nos listed in the bible. Picking on one particular thing simply because they find it icky is hypocritical. The administration is simply being bigoted and hiding under the umbrella of religion.

    This story is not whether or not the women should be lesbian, but whether or not their application should have been denied. Be hateful all you want since that seems to be permissible now, but at least try to be honest about why you’re being hateful. Picking and choosing what bits of your bible you will or won’t follow is laughable at best, hateful at worst.

    Love as has already been stated is Jesus number one commandment. Genuine True Brotherly Sisterly Love will correct so many of the issues in our modern world. Leaving judgment up to God and not passing judgment with our finite understand would certainly solve a lot of our issues as well. I with Gods help came to terms with my sexual orientation a number of years ago. I studied beyond what I had been taught growing up in church and even what I had preached and taught from pulpits myself. I KNOW where I stand with God. I REFUSE to argue with anyone who disagrees with how God through His Spirit has directed me concerning ME. If it were me I would not want to live in a community that did not want me there. I do however think that this retirement community should make this perfectly clear that they hold those beliefs before the application process starts. If they feel the need to take it to court then that is also their decision and I don’t condemn them for that. It does hurt my heart to read the anger and hate that seems to come out here when someone disagrees with someone else. My understanding when I joined this organization was that it did not specifically endorse a certain set of beliefs. If you cant associate with and communicate with brothers and sisters here without getting so upset and not be loving and accepting then maybe you are in the wrong group.

You don’t have to agree on whether gays are going to hell or going to heaven, or whether they please the Lord or offend the Lord, or whether the Bible says one thing or the other. But I’d expect people of religion to conduct their debate in a manner that reflects their alleged religious affiliation. All I’ve read so far is satanic affiliation.

    If you guys were really people of any god, you could debate respectfully and politely rather than resorting to hate and name calling.

      Its why they call it “universal”, people are allowed to believe as they wish, it’s the down side of accepting everyone, you literally have to accept everyone, not the illusion that we place on what we believe spiritual people should be. It’s the main reason I left religion altogether. !!! But, there is a huge difference between religion and spirituality, and just because people are one or the other or both doesn’t mean it’s all light. We are both light and dark and we live and express both sides, you can’t have one without the other. But you do have a good point, and I will admit myself, that some of my comments didn’t exactly come from a place of light, but hey, much of my sarcasm comes with a point that would otherwise not be known. The point dear brother, is that if your looking to find people like yourself, your in the wrong place, but if your looking to push the boundaries and challenge yourself to true acceptance, this is the perfect place to it!

Whatever rights you think you may have that are greater then their first amendment rights are not written in the constitutuion, and are not God given, all rights come from God almighty, and this establishment like any other has the right to refuse you service. Perhaps what your really looking for, is not a comfortable place to live for both you and your neighbors, but perhaps what you really seek is attention, furthering an agenda that God almighty calls an abomination, and I might also think your looking for some easy money. May I suggest you both be not so selfish and find another place to live, making things best for all.

If a gay couple wants to love and praise God we don’t stop them any Christian that discriminates against someone else are not true Christian’s.       We hear lots from the ‘God is love, love this and that, accept anything, peace at all costs’ camp. Your opinion as ‘love and acceptance for all’ is NOT God’s opinion.

      God hates and judges: (homosexuality) Leviticus 18:22; (divorce) Malachi 2:16; (and many common sins) Proverbs 6:16-19, just to name a few instances.

      Jesus judges in Mathew 7:16 (dogs, pigs, false prophets); Matthew 23:23 hypocrisy) and in many other passages.

      Jesus encourages US to judge,discern in Matthew 7:24 (rightly); Luke 17:3 (rebuke the errant) and in other places.

      We are to be judgmental and perceptive of other’s actions and attitudes, as our Lord is. And we are to love the sinner, yet hate sin, as He does.

      Your Canadian opinion presents a spineless approach to Truth, and a compromise of God’s Word, ‘Rev’.

        Bob, I read in the Scriptures that many of its writers hated and judged homosexuality, divorce, and many common “sins”, but not that God Himself hated any of these things, even though they, the same as you, wanted to set themselves up as “the voice of God” in this world!!! If the “God is love, etc.” camp is the “peace at all costs and spineless” camp, then I guess that you must belong to the “no peace at any cost whatsoever” and brainless camp! If God isn’t a schizophrenic, then He couldn’t possibly have said “Love your neighbor as yourself” and “do unto others as you would have others do unto you” (more of that “love garbage” right?!), while telling us to judge them at the same time. This “love the sinner, yet hate sin” line of yours only seems to apply to homosexuals’ and others’ that you dislike “sins”, but not to any of the sins that other people see in YOU!!!, such as bigotry, narrow-mindedness, self-righteousness, holier-than-thouness, pretentiousness, hypocrisy, and this sin of a double standard (one standard for yourself and a different standard for gay people and others), which allows you to have all of these other sins! My proof that they did so is that God isn’t a bigot. So, if there is ever any bigotry found in the Bible (and there is lots of it!), God didn’t put those words into His own mouth, but they were put there by people in ancient times and today, such as yourself, for the purpose already stated. If I see a murdered person in a room, I don’t have to guess, but know for a certainty, that there was a murderer who put it there.           Perhaps it’s not God that is bi-polar, but people’s view of what God is…The reality is, God is both light and dark. Hate and anger are not the opposite of love, it’s an aspect of it, believe it or not. Apathy would be the opposite of love. These men in the bible obviously had a more personal relationship with their God and asked advice on how to handle situations during their time and in their culture. God answered them according to their own beliefs and cultures, but it doesn’t mean it’s the same advice he would give to you. It’s not a tell all for everyone. Just like you wouldn’t give all of your children the same advice because they are all different people. Religion is merely a society of people who agree to live by the specific guidelines for that community. Spirituality is that personal one on one that tells you “hey, I don’t agree with this doctrine,belief, or I feel there is a different interpretation of it because this teaching doesn’t sit right with me.” This is why there is so much confusion because everyone is looking for a custom fit on an off the rack religion. To thine own self be true. Jesus and every other mystic never looked at a book to teach them God, they looked within. Jesus, well the bible, said that the kingdom of heaven isn’t above, it’s within. Jesus never meant for his teachings to be a religion, in my opinion, he was merely teaching people to listen to the God in their hearts, not at the synogog. We all have to do what is right within and it’s going to create conflict, that’s just an example of the extent of how far freewill can go! The price of freewill is to be unbound from chains and control, which often leads to chaos, which is why some many governments have chosen religion, in order to control the masses from chaos. One set of rules that everyone follows so everyone knows how to live together in society. It’s why Islam is rising so much. Governments want it because the rules are very black and white on citizens behaviors. And, though I don’t agree with their doctrine, you don’t see alot of the chaos you do here. We, as Americans and western countries want our freewill and with that freewill come conflict. But to answer your question, truth is subjective and the only thing that makes a truth a truth is one’s belief in it. Perception makes it subjective. This is why someone can stack a bunch of “proof” in front of you and you can argue it away, because to them, it is solid proof, and to you it’s complete nonesense and you see no proof. It;s this process that allows us to grow and also change our perceptions so we are not always stuck in the same mind frame, we grow and that is the purpose, imho. If God expected us to chose him and punish us for not doing so, then this wouldn’t be true freewill. So, perhaps, mankind has missed the entire point and the point is following the God that lives in your heart and not the God that other people perceive.     This was by no means an accident, there are over 480 assisted living facilities in Missouri and the gay couple happened to pick the Christian facility. A facility that advertises that it is “Guided by Biblical Values”. This was an attack on Christianity, plain and simple. It was an attack on religion. Its sad that the people who want to be treated equally go out of their way to attack another group.

    The court case will depend of some things not explicitly stated in the article. For example it states the website explains the policy. Quote: “The organization’s website explains that it is “guided by Biblical values” and its cohabitation policy defines marriage as “the union of one man and one woman, as marriage is understood in the Bible.” Is the definition of marriage ON the contract? Can the organization show that it has also refused a heterosexual couple not married to each other? The name of the organization does not show any religious affiliation so the normal perception would be that one doesn’t have to believe in a certain way. And of course, if the plaintiffs do their judge shopping well to get a Liberal judge they will probably win, at least the first go round.

    These two women have open up a can of worms. Just by asking who are the couples in that complex. Did any of them know or was raise with the other in the first 18 years of their life.
    Pastors have you ever had two lesbians sisters ask the question about their lifestyle. What lifestyle in the Bible that was written 2000 years ago when all females of any religion when they reach 13 years of age got pregnant rather they like it or not. Both of them would have bare a child until they died in child birth.

    This article has really hit closer to my heart, especially recently.My oldest daughter is transgender. I didn’t know until she turned 18 and I had to hospitalize her for a suicide attempt. When I went to the hospital and had a meeting with her and the councilor, this is when she told me. I was floored, not because she was transgender, but because she thought we would reject her because of it. I told her that all I ever wanted from her and all of my children is to be who they are going to be and to proud of who they are, no matter what anyone else thinks, but most important, to be happy with who they are. Though our family has always supported her, it took 8 years to start actually transitioning. She lives as a woman full-time and I’m very proud of her courage and strength. As a mother, I am proud that she learned what I wanted to teach her. But I also tried to teach her that not everyone is going to accept her and she is going to have to accept other’s decisions to not accept. I wish it was a simple as people simply not agreeing but this is not the case. She has been on hormone therapy for 2 years now. We recently relocated temporarily from a small town to a large city. This city is known for it’s liberalism and I figured this would make her transition quite easy. Boy was I wrong! Due to insurance issues, the original doctors unenrolled her and the new primary doctor doesn’t even take her insurance! So we had to rely on urgent cares and many doctors unwilling to give her a prescription. We went to one that not only refilled her prescription for a month but gave us a referall to a doctor he worked under before that takes her insurance! Sounds great, right? Nope! We went in and saw the doctor and the doctor said that there was nothing in the medical books that required him to give hormones to a man and basically kicked us out of his office without a prescription. He did make his receptionist send out a referral to a specialist so I wouldn’t sue, but the specialist appointment was still almost 3 months away. This complicated things more at the urgent care as more doctors wanted her to get it through her now PCP. So we had to taper her down from her original dose which came with withdraws. We went to another urgent care and was accused of jeopardizing their doctors by asking for it and basically kicked out of that office as well. We went to another, explaining the story all over again and that doctor gave her another 30 days. We have all the documentation, her medical history and even the psych approval for the medication, but there is so much hatred towards transgender’s that even medical doctor’s have the “choice” to deny medical attention to her and are allowed to place her heath at risk all for the sake of their beliefs. I understand that buissness should have the right to risk their buissness in order to stand up for their beliefs, but when it comes to the basic needs of human beings, such as the ability to seek medical attention, buy food and obtain shelter, it should be illegal. I’m no longer Christian, but I do believe that people have the right to believe as they wish, but when we are risking the health and basic needs of people, whether we like it or not, are a part of our society, then, we, as a society has a serious problem. We have been rejected by family members and friends, over religious beliefs, and I’, ok with this, but I’m not ok when people are denied their basic needs all for the sake of religious preference. Prejudice and discrimination comes in many forms. You can’t say you are against discrimination when you are denying people their basic needs. I’m not talking about a baker refusing to bake a stupid cake, because people can survive without a wedding cake, I’m talking basic needs. People say that this couple can go elsewhere. They told us that to, but when the majority of people are denying you medical care, then I have to also assume that many other places are also denying them medical care as well. Senior center’s aren’t just to give old people a place to live. They often have more limited mobility and need more assistance in order to do their day to day activities. Most of these homes have different levels of care and we really don’t know how much care these women need. So, no, they are not just being denied housing, they are also being denied medical assistance and they have probebly tried several other places as well. Society assumes that eventually someone will hook them up, but that’s not usually the case. You don’t really how limited you are until everyone decided to excercise their religious rights and deny you your own basic needs of survival. To think this is the only place they applied and denied is naive at best. What if the tables were turned and this was your daughters or sons? What if they were denied needed medication or medical services because a pagan decided not to help your daughter and son and shoving them off to someone else? What if you had to see your child suffer because your child had to go without medications until you could find the next kind soul? Even though I have my own opinions about Christians, I could not watch another human being suffer withdrawls and instill that type of pain and fear into another human being. You don’t think there was fear in my daughter? Fear about the side effects? You think she wouldn’t have the same withdrawl symptoms as your mother is she stopped taking her hormone pills? Would you be ok if the doctor just said ” sorry, I don’t do hormones, go find someone else even though your almost out.” But it’s a personal and religious choice, right? Technically I could do that because I don’t believe in Christianity, right? What about these women? Have you ever been scared of going homeless because all the doors you tried have closed and all you have is a small hope that one heart will be open enough to keep you off the street? Or be limited on money and the only place you could afford wouldn’t take you, just because the person you are married to doesn’t “fit in”? And what if the person you loved had cancer? You all can keep your wedding cakes, but it’s not right that tax paying citizens of this society is being denied their basic needs. People have more sympathy towards murderers then they do transgenders and gays. I don’t ask you to agree with my daughter’s life style, but I do ask that you stop the suffering of people different then you and denying them the healing and bread that your Jesus would have given them. I hope that you don’t ever have to walk in these shoes, but if you do, I hope you remember my story and I hope you will find more love and compassion then what we have been given.
